The website www.kultkefir.com is the property of Kult Kefir SRL. The seller, Kult Kefir, is registered under VAT number BE 0772.330.925. All orders are considered acceptance of these terms and conditions by the buyer. These terms and conditions form an integral part of the agreement as described below.

1. PRICE

The prices of products and services are indicated in euros, including VAT, excluding transport costs and/or other taxes or levies, unless otherwise stated or agreed in writing. Payment can be made using one of the methods offered during the ordering process. Orders will only be processed after payment has been received by Kult Kefir. In the event of non-payment, Kult Kefir reserves the right to suspend or terminate the contract and any related agreements.

All offers are non-binding and Kult Kefir reserves the right to change its prices. If a price increase occurs between the order and its delivery, the buyer has the right to cancel the order and terminate the agreement within seven (7) days after Kult Kefir announces the price increase.

The prices indicated apply only to the items described in the text.

The photos are for illustrative purposes only and may contain items not included in the price.

Invoices are payable in full at our registered office at 56 Avenue Alphonse XIII, 1180 Uccle, Belgium, on the due date, net and without discount, unless otherwise stated on the invoice.

To be valid, any complaint about an invoice must be made by registered letter, in detail, within three (3) days of receipt.

In the event of late payment, interest of 1% per month shall automatically be payable on outstanding amounts from the invoice date, without prior notice being required.

In the event of non-payment, if a reminder sent by ordinary post remains unanswered within 14 days, a fixed compensation of 10% of the unpaid amounts will also be due.

We reserve the right, in the event of total or partial non-payment of an invoice by the due date, or in the event of a breach by the customer of their contractual obligations, to suspend or terminate immediately, without prior notice and without judicial intervention, the performance of all contracts with the customer, and to demand immediate payment of all claims, even those not yet due.

Failure to react immediately to a breach by the buyer shall never constitute a waiver of our rights.

2. ACCEPTANCE OF THE ORDER

An order is only binding for Kult Kefir after it has been confirmed by email or upon commencement of its execution. Kult Kefir reserves the right to refuse an order or impose specific conditions on it, unless explicitly stated otherwise.

All product information, prices and order information are subject to change or correction.

3. DELIVERY

The delivery times provided by Kult Kefir are indicative. The maximum delivery time is fourteen (14) days after receipt of the order, except for payments made by bank transfer, in which case the maximum delivery time is 7 days after receipt of payment.

Exceeding the delivery deadline does not entitle the buyer to claim damages or cancel the order or contract, unless the deadline is exceeded to such an extent that the buyer can no longer reasonably comply with the agreement. In this case, the buyer may cancel the order or terminate the contract.

The buyer is responsible for delivery errors due to an incorrect address. Additional charges may apply in this case.

In the event of non-delivery, all amounts paid will be refunded without interest or additional compensation.

If a product ordered is not in stock, this will be indicated. Once the products have been delivered to the address provided, the risks are transferred to the buyer.

Deliveries are made by hand, by post or by courier. Delivery costs are communicated before the order is confirmed. If delivery costs cannot be calculated automatically, an indication will be provided.

4. RETENTION OF TITLE

The delivered goods remain the property of Kult Kefir until full payment has been received, including any costs and interest. In the event of non-payment, we reserve the right to take back the goods at the buyer's expense.

5. COMPLAINTS

To be considered, complaints must be sent to info@kultkefir.be.

In the event of delivery not complying with the order, the complaint must be made within seven (7) days of the order. In the event of a hidden defect, the complaint must be made within seven (7) days of discovery of the defect.

The complaint must include a detailed description of the problem, as well as proof (photo).

6. WARRANTY

Kult Kefir's warranty is limited to the warranty against hidden defects and that provided by Belgian consumer law.

Kult Kefir is only liable for damages resulting from gross negligence or malicious intent.

We are not liable for any indirect, special or consequential damages of any kind caused to the purchaser.

7. RETURNS

The consumer has a legal period of fourteen (14) days from the date of order to return products ordered from our online store. Kult Kefir will refund the products (excluding shipping costs) under the following conditions:

• Compliance with the 14-day deadline (calculated from the date of order).
• Sending an email to info@kultkefir.be to report the return.
• Product returned in its original packaging.
• If a gift was included in the order, it must also be returned.

If a product is received damaged, proof must be provided in the form of a photo dated on the day of receipt (to be sent to info@kultkefir.be).

If the return is compliant, Kult Kefir will ship a new order within a maximum of fourteen (14) days after receiving the returned items.

8. FORCE MAJEURE

Kult Kefir cannot be held liable for any delay or failure to perform its obligations caused by circumstances beyond its control, such as: shortage of raw materials, interruption or permanent cessation of production, strikes, lockouts, commercial disturbances, commercial disputes, power cuts, delays or failures on the part of its suppliers, even if these circumstances were foreseeable.

The absence of an immediate response to a breach by the buyer shall never be considered a waiver by Kult Kefir of its right to assert its rights at a later date.

9. INTELLECTUAL PROPERTY

Our website, logos, texts, photos, names and, more generally, all our communications are protected by intellectual property rights belonging to us or to our suppliers or beneficiaries.

It is strictly prohibited to use and/or modify these elements without our prior express written authorisation. This includes, in particular, the reproduction or copying of drawings, photos, texts, logos, colour combinations, etc.

Kult Kefir is a registered trademark in the Benelux countries.

10. APPLICABLE LAW

All contracts concluded with Kult Kefir are subject to Belgian law.

Any dispute between the parties shall be submitted exclusively to the competent courts of Belgium.

The buyer may exercise their right of withdrawal within fourteen (14) days of delivery of the product or signing of a service contract, without penalty and without having to provide any reason.
